Public Path Diversion Order 2021

On 6 November 2024, the Secretary of State for the Environment confirmed the above order made under section 119 of the Highways Act 1980 and section 53A(2) of the Wildlife and Countryside Act 1981.

The effect of the order as confirmed is to divert Footpath 94 (Byfleet) from a point west of the Manor House (Grid Ref. 506978 160275) in a north easterly direction for 190 metres then in a north north easterly direction for 30m to its junction with Bridleway 95 (Byfleet) (Grid Ref. 507172 160381) to a line running from the same point in a generally north north easterly direction for 152 metres to Grid Ref. 507079 160382, then in a north easterly direction for 35 metres to its junction with Bridleway 95 (Byfleet) (Grid Ref. 507111 160395), as shown on the order map.

A copy of the order as confirmed and the order map may be seen free of charge at the Countryside Access Office, Surrey County Council, Merrow Depot, Merrow Lane, Guildford GU4 7BQ (by appointment Tel 0300 2001003), at Woking Borough Council, Civic Offices, Gloucester Square, Woking GU21 6YL, and at West Byfleet Library, The Old Sorting Office, Rosemount Avenue, KT14 6LB during opening hours. The notice may also be viewed at www.surreycc.gov.uk. Copies of the Order and map may be bought from the County Council for £4.

As respects to the route to be created the order came into force on 6 November 2024, and as respects to the route to be extinguished comes into force on the date on which Surrey County Council certify that the terms of Article 2 have been complied with, but if any person aggrieved by the order wants to question its validity, or that of any provision contained within it, on the ground that it is not within the powers of the Highways Act 1980, as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within 6 weeks from 5 December 2024, make an application to the High Court.
