The reasons why we use your personal data

This privacy notice applies to the functions of the Highways Operations and Infrastructure Group within Highways and Transport.

We collect personal data in order to provide a focused highway service to residents, customers and elected officials.

This will include, but is not limited to:

  • License applications
  • Enquiries
  • Defects reports
  • Insurance claims
  • Requests for information
  • Enforcement
  • Proactive provision of information on highway services and works
  • Information is used to maintain records of the highway asset and collect data through surveys, consultations and other means to measure satisfaction and to improve our services.

What processing of personal data is undertaken by the Service?

Your personal data is collected for the purposes of providing a customer focused highway service and the performance of statutory functions.

In addition, we collect your personal data for the following:

  • Service delivery
  • Service improvement and planning
  • Statistical analysis and reporting
  • Vital Interests
  • Provide information about the Highway Service

What information do we collect?

The information we collect may include some or all of the following:

  • Name
  • Address
  • Email address
  • Telephone contact details
  • Date of birth
  • Land registry title details
  • Property deeds
  • Opinions on proposals (includes surveys and consultations)

How we are allowed to use your personal data

The Code of Recommended Practice on Local Authority Publicity requires us to keep people informed about what Surrey County Council is doing in order that they can hold us to account.

For some activities we have a legal obligation or can act under a public interest task under various UK legislation. This includes, but is not limited to:

  • Local Government Act
  • Localism Act 2011
  • Crime and Disorder Act 1998
  • Road Traffic Regulation Act 1984
  • Traffic Management Act 2004
  • Highways Act 1984
  • Health and Safety at Work Act

The use of your personal data is necessary for the performance of a public task, including responding to complaints, enquiries and requests for information.

We also use data where necessary for contract with the individual or to protect the individuals / another's vital interests

How we are allowed to use your personal data

Consent

For some activities, to process your personal data, we will seek your consent. In such instances we will explain to you what we are asking you to agree to and why. If we have consent to use your personal data, you have the right to remove it at any time.

Who we share your personal data with

We may share your data with Councillors and other departments within the county council, or externally, in order to respond to an issue you have raised with us or take forward an area of work.

If you choose to share your contact details with us these will automatically be stored and may be used by them to mediate and resolve your enquiry and any future enquiries you make to Surrey County Council. For further information please see the Customer Services privacy notice.

This will also include other local authorities, such as district and borough councils and approved highway contractors. Where information is shared with contractors we have taken steps to ensure that data is protected in accordance with GDPR.

Where information is gathered in response to consultations or surveys the results will be shared with relevant parties and may be published on our website but no customer or personal data will be shared.

Retention of data Data will be retained in accordance with the our data retention schedule.
