The reasons why we use your personal data

This privacy notice applies to the functions of the Minerals and Waste Planning Policy service that incorporates and carries out statutory planning functions of Surrey County Council as the County Planning Authority.

What processing of personal data is undertaken by the service?

Your personal data is collated for the purposes of local plan monitoring and preparation, public consultations, and Duty to Cooperate obligations as required by and in order to carry out our statutory responsibilities pursuant to the Town and Country Planning Act 1990, Planning and Compulsory Purchase Act 2004, Localism Act 2011, and the Town and Country Planning (Local Planning) (England) Regulations 2012. In addition, we collect your personal data for the following:

  • Service improvement and planning
  • Prevention and detection of crime/fraud
  • Research
  • Statistical analysis and reporting
  • Safeguarding
  • Vital Interests

What information do we collect?

Name, Address, Contact Details, Gender, Age, Disability Status, Employment Status and Ethnicity (Anonymised)

How we are allowed to use your personal data

Legal obligation or public task under the Town and Country Planning Act and various UK legislation including but not limited to:

  • Local Government Act
  • Localism Act 2011

Consent

When we have asked for your consent to process your personal data, we will explain to you what we are asking you to agree to and why. If we have consent to use your personal data, you have the right to remove it at any time. If you want to remove your consent, please contact us at the following email address mineralsandwaste.localplan@surreycc.gov.uk and we will deal with your request.

Who we share your personal data with

Issues and options consultation period:

When making comments individuals will need to give their name and address. Stakeholders receive a summary of the consultation responses in the publication of related publications including Select Committee and Cabinet reports and annexes. Responses will include the authors name but no other personal information such as private telephone numbers, e-mails or addresses. A summary of the responses will be published on our website and submitted to the Independent Planning Inspector, responses will be named but no further personal information will be published.

Regulation 18 consultation period:

In order to submit comments individuals will be required to give their name and address. Stakeholders receive a summary of the consultation responses in the publication of the related Cabinet paper and annexes. Responses will include the authors name but no other personal information such as private telephone numbers, e-mails or addresses. A summary of the responses will be published on our website and submitted to the Independent Planning Inspector, responses will be names but no further personal information will be published.

Regulation 19 period of representations:

Under Regulation 22 of the Town and Country Planning (Local Development) (England) Regulations 2012, we are required to submit all representations to the Independent Planning Inspector and make copies of representations publicly available. Representations made during the Regulation 19 Period cannot be treated in confidence. The Council will also provide names and associated representations to the Independent Planning Inspector and on its website but will not publish personal information such as private telephone numbers, e-mails or addresses.

Consultations on main modifications

As part of the examination of a Local Plan, main modifications may be identified and proposed to make the plan sound and legally compliant. The Council is required to consult on these main modifications. We are required to submit all representations received to the Independent Planning Inspector and make copies of the representations publicly available. Representations made as part of this consultation cannot be treated in confidence. The Council will also provide names and associated representations to the Independent Planning Inspector and on its website but will not publish personal information such as private telephone numbers, emails or addresses.

By submitting a representation on the Surrey Minerals and Waste Local Plan or any of the associated documents you confirm that you agree to this and accept responsibility for your comments. Please note that we are unable to accept anonymous representations.

Retention of data

Data will be retained for 5 years in accordance with our countywide data retention schedule.
