Byway Open to All Traffic Nos. 137 (Effingham) and (Wotton) known as Drove Road (D263)
(Prohibition of Traffic) Order 2021
On 10 February 2021 Surrey County Council made The Surrey County Council Byway Open to All Traffic Nos. 137 (Effingham) and (Wotton) (Prohibition of Traffic Regulation) Order 2021 under sections 1 (1), 2 (1) and 2 (2) of the Road Traffic Regulation Act 1984, the effect of which would prohibit vehicles with four or more wheels and exceeding 7ft in width from entering or proceeding in those lengths of the BOAT known as Drove Road at points A (grid ref. 511436 149706), B (grid ref. 511453 149709) and C (grid ref. 512013 149984) as shown on Drawing. No. 3/1/58/H18.
The prohibition would not apply to vehicles which need to use the BOATs in association with use of the adjacent farm premises or land, or any vehicle requiring access to the above mentioned BOATs for the purpose of exercising any statutory duty therein or the exercise of private vehicular rights.
A copy of the proposed Order, together with a plan showing the lengths of BOAT to which the Order relates and a Statement of the Councils Reasons for making the Order can be inspected free of charge at the Countryside Access Office, Surrey County Council, Merrow Depot, Merrow Lane, Guildford GU4 7BQ (by appointment Tel 0300 200 1003) or email email@example.com to request a copy.
If you wish to question the validity of the Order or of any provision contained within it on the grounds that it is not within the power conferred by the Act, or on the grounds that any requirement of the Act or of any Instrument made under it has not been complied with in relation to the Order you may, within six weeks from the 26 February 2021 apply to the High Court for this purpose.
