Order making

A map modification order was made under delegated powers on 9 January 2019 and advertised on 18 January 2019 for 42 days. The order is title "The Surrey County Council Footpath No. 97 (Esher) (part of) Definitive Map Modification Order 2019".


No objections were received to the Order within the relevant period. The Order was confirmed on 13 March 2019 and advertised as such for 42 days from 19 April 2019.


Part of this route was dedicated as a public footpath by the landowner on 4 November 2015. As it was then subject to development and building works this new footpath, 97 (Esher), was closed by a temporary prohibition of traffic order on 18 December 2015. Following this closure, the landowner applied to divert footpath 97 by Order under section 257 of the Town and Country Planning Act 1990. An Order was made on 19 April 2016 and confirmed without objection on 1 June 2016. The Order was certified as created to the reasonable satisfaction of Surrey County Council Countryside Access Team on 30 January 2018. A small section of the original claimed path was not subject to the dedication of footpath rights on 4 November 2015. This section is being dealt with by the normal Map Modification Procedure.
