Notice of Confirmation of an Order

On 23 February 2023, Surrey County Council confirmed the above Diversion Order made under section 119 of the Highways Act 1980 and section 53A(2) of the Wildlife and Countryside Act 1981 and the above Extinguishment Order made under section 118 of the Highways Act 1980 and section 53A(2) of the Wildlife and Countryside Act 1981.

The effect of the Diversion Order as confirmed is to divert footpath 599 (Witley) running from O.S. Grid Reference 493943 138939 in a northerly turning to easterly direction for 77 metres to O.S. Grid Reference 493998 138973 to run from O.S. Grid Reference 493943 138939 in a south easterly turning to north easterly direction for 115 metres to O.S. Grid Reference 494029 138971, and divert public footpath 600 (Witley) running from O.S. Grid Reference 493998 138973) in a northerly turning to north westerly direction for 115 metres to Point 'C' (O.S. Grid Reference 493938 139105 to a line running from O.S. Grid Reference 494029 138971) in a northerly turning to a generally north westerly direction for 173 metres to O.S. Grid Reference 493938 139105. Both paths to have a width of 4 metres.

The effect of the Extinguishment Order as confirmed extinguishes part of public footpath 601 (Witley) running from O.S. Grid Reference 493998 138973 in an easterly direction for 28 metres to O.S. Grid Reference 494029 138971.

A copy of the Orders as confirmed and the Order Maps have been placed and may be seen free of charge by appointment (Telephone 0300 200 1003) at Surrey County Council Offices, Whitebeam Lodge, Merrow Depot, Merrow Lane, Guildford (between 10.00am and 4.00pm from Monday to Friday) and at Waverley Borough Council, the Burys, Godalming, GU7 1HR during normal office hours and at Godalming Library, Bridge Street, Godalming, GU7 1HT during opening hours.. Alternatively copies of the Orders and maps may be purchased from the County Council at a cost of £4 per order.

The Orders came into force on 23 February 2023 but if a person aggrieved by the Orders wants to question their validity or that of any provision contained in them on the ground that it is not within the powers of the Highway Act 1980 as amended or on the ground that any requirement of the Act as amended or of any regulation made under the Act has not been complied with in relation to the Order he or she may under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act within six weeks from 3 March 2023 make an application to the High Court.
