This was considered by the Planning and Regulatory Committee of Surrey County Council on 8 June 2016. Members agreed with the Officer's recommendation to upgrade to public bridleway, footpaths 129 (Byfleet), 3 (in part) and 566 (Wisley) on the Definitive Map and Statement for Surrey.

Order making

A Map Modification Order was made on 20 July 2016 and advertised on 29 July 2016.

Due to an administrative omission the Order was advertised for a second time from 24 March 2017.


Eight objections were received to the first notice. The Order and all received evidence and objections were referred to the Secretary of State for determination at the end of the second notice period. Three new objections and two other new representations were received to the second notice period.

Public Inquiry

The Secretary of State appointed an Inspector to determine this matter. A Public Inquiry was held at The Council Chamber, Woking Borough Council, Civic Offices, Gloucester Square, Woking GU21 6YL on 22 May 2018. This was adjourned after one day so that new evidence could be considered. The Inquiry recommenced 6 February 2019 and continued until the 7 February 2019 after which it was adjourned again. The Inquiry continued on 19 and 20 March 2019 at the same venue.

Decision and confirmation

The Order was confirmed by the Secretary of State on 22 July 2019 and will be advertised as such for six weeks from 9 August 2019. A copy of the decision can be viewed on the Planning Inspectorate's decision webpage on

High Court

On 19 September 2019 an appeal was made to the High Court by Paul Garland and Haroun Salaman, challenging the Inspector's decision. The hearing for this appeal was held on 3 December 2019. This was defended by the Government Legal Department. In the judgement dated 10 July 2020 Mr Timothy Mould QC dismissed the appeal in its entirety.

Court of Appeal

On 8 July 2021 the matter the Court of Appeal considered an application from Mr Garland and Mr Salaman to quash the Order on the basis that it would constitute a public nuisance. The appeal was dismissed in the judgement dated 20 July 2021.
