The reasons why we use your personal data
This privacy notice applies to the functions of the Highways Enforcement Team that carries out enforcement functions on the highways within Surrey.
What processing of personal data is undertaken by the team
We use your personal data for the purposes of investigating enquiries in order to carry out our statutory responsibilities under the different legislative frameworks. In addition, we collect your personal data for the following purposes:
- Service delivery
- Prevention and detection of crime including taking enforcement and legal action where necessary
What Information do we collect?
The Highways Enforcement Team collects personal data from a range of sources. The types of personal data we process may include information such as:
- Name
- Address
- Email Address details
- Contact landline or mobile phone number
- Your image
We use Unmanned Aerial Vehicles (UAVs) to document a site at a specific time from the air, to provide a clear record of the condition and layout of the area of land and property that forms part of an enquiry.
How we are allowed to use your personal data
- Highways Act 1980.

- Flood and Water management Act 2010
- Clean Neighbourhoods and Environment Act 2005
- Town and Country Planning (Control of Advertisements) Regulations 2007.
- Town and Country Planning Act 1990
- Air Navigation Order 2016
- European Union (EU) 2019/947 and UK Regulation (EU) 2018/1139 – ‘The Basic Regulation’
Drone operations are required to be maintained at a set legal separation distance from pedestrians and onlookers under the Civil Aviation Authority (CAA) regulations.
These are in two categories:
- Those who give verbal consent (classed as involved persons under CAA regulations) require a 30m horizontal minimum separation distance
- Those persons who it is impractical to approach (classed as non-involved persons under CAA regulations) require a 50m horizontal separation distance
Consent
Where we have consent to use your personal data, you have the right to remove it at any time. If you want to remove your consent, please contact us at: informationgovernance@surreycc.gov.uk and we will deal with your request.
Who we share your personal data with
It may be necessary for us to share your personal data with the following organisations or partners:
- District & Borough Councils
- Parish Councils
- Confirm Enquiry system
- Driver and Vehicle Licensing Agency (DVLA) - registration numbers only, used as a means to obtain registered keepers details from DVLA
- Civil Aviation Authority (CAA)
Retention of data
All stored data, such as in the case of Confirm related enquiries and drone imagery (and associated data), will be retained for 6 years in accordance with the current SCC countywide data retention schedules.
