For planning purposes fairs are treated as a temporary land use. Temporary use of land for less than 28 days per year is regarded as "permitted development" under Part 4 of the Town and Country Planning Order 1995 and is thus deemed to have planning permission. However, a planning application would need to be submitted for more permanent use of land for fairs. Local authorities must determine applications in accordance with the development plan unless material considerations indicate otherwise.
